All policies arranged through Casus Underwriting Limited are administered through other regulated insurance intermediaries. The majority of your personal information held by us is initially provided by you to these intermediaries, who then transfer the information to us.

Additionally, we may gather your personal data from various third-party sources, such as credit reference agencies, sanctions search tools, due diligence providers, claims handlers, publicly available information (such as your websites), social media platforms, survey companies that have visited your business, law enforcement agencies, and other participants in the insurance market.

We may also request information from you about other individuals who will benefit from the product or services we provide.

If you provide us with information about another person, it is your responsibility to ensure and confirm that:

  • you have informed the individual about who we are and how we use personal information, as outlined in this Privacy Policy.

Risk coverage details – information necessary to assess the risk to be insured and provide a quote. This may include data relating to your health, criminal convictions, or other special categories of Personal Information. For certain types of policies, this could also include telematics data.

Previous and current claims – information about previous and current claims (including other related insurances), which may include data relating to your health, criminal convictions, or other special categories of Personal Information and, in some cases, surveillance reports.

(7) Automated Decision Making

Automated decision-making is a process whereby decisions, with effect on an individual, are made using automated computing means (i.e., without involvement of a human). Profiling is an automated process whereby Personal Information is processed to evaluate certain personal aspects of an individual to analyse or predict behaviour or aspects.

As explained above in Section 5: Why Do We Collect Your Personal Information. Casus may perform data analytics to establish risk patterns and categories. When calculating risk and insurance premiums and where such is permitted by applicable law, we may compare your personal information against these industry averages and patterns. This insurance specific exercise is considered profiling and/or automated decision-making and is necessary to enter into a contract with you – to confirm that the premium amount reflects and adequately matches the associated risk – and/or authorised under applicable law. As a result of these profiling activities, you may be offered a different insurance policy and/or premium, or even be refused insurance.

Profiling may also be used to assess information relating to you, to identify and have a good understanding of fraud patterns. Where special categories of personal information are relevant, such as medical history or past criminal convictions for certain types of insurance, such special categories of Personal Information may also be used for profiling. However in this case, and where relevant, your prior consent will be requested unless reliance on another legal basis to process this data for profiling purposes applies.

(8) Sharing and Safeguarding your personal information

We ensure the confidentiality of your personal information and will only share it with other parties when necessary for the activities we undertake, with your consent, or when required by law or regulation (such as for crime prevention and detection purposes). We ensure that our partners or suppliers have adequate measures in place to safeguard your information.

As an insurance intermediary, we are obliged to disclose personal information to insurance companies, underwriting agencies, business partners, and other relevant parties to provide our products and services and facilitate insurance contracts. This may include other insurance intermediaries, loss adjusters, regulatory bodies, and legal and accountancy firms involved in claims handling. Additionally, we may share your information with fraud prevention agencies like the Claims and Underwriting Exchange Register and Motor Insurance Anti-Fraud and Theft Register.

We may also disclose your information to service providers engaged to perform services on our behalf. These service providers are contractually obligated to use the information solely for providing services on our behalf or to comply with legal requirements.

In the event of a merger or acquisition, we may disclose personal information to new owners of our business. Additionally, disclosure may be necessary for company audits, regulatory inspections, or investigations into complaints, suspicions of fraud, or security threats.
